Following the murder of George Floyd, the Black Lives Matter-movement (BLM) took to the streets to protest against institutional racism. In these protests, one could often hear the slogan “No Justice, No Peace”. Drawing on legal theory, speech act theory and phenomenology, this article investigates what kind of justice and peace are called upon and how the slogan functions as a claim addressed to the legal order. First, the article shows that the rule of law provides a comprehensive normative framework (...) to evaluate what went wrong during the arrest of George Floyd. This article aims to provide a semiotic analysis of environmental law and youth protests. More precisely, drawing on speech act theory this article regards both as types of communication and teases out the inherent voice and message, specifically with regard to the interests of future generations. The argument unfolds in three steps. First, the article looks into speaker and speech of environmental law and argues that it speaks, as legislation does, in the first-person plural voice of a ‘we’. Second, the (...) article examines a speech of Greta Thunberg through the lens of Stanley Cavell’s theory of passionate utterances. This interpretation will unlock the political stakes of Thunberg’s speech as she claims standing with those responsible for enacting environmental law. Finally, the consequences of this reading will be analysed by relating message and voice of environmental law. As youth protests question ordinary forms of political representation, new ways of safeguarding the interests of future generations are called upon. (shrink)

Ulrich Beck characterized the transition from modern to late modern society as a shift from an industrial to a “risk society.” Contemporary society is challenged by negative side effects of modernization, including the increasing and imminent threat of global climate change. This article will test the validity of conceivable prescriptive elements associated with this sociological theory. In doing so, it will focus on the most recent legal developments aimed at tackling climate change within the EU. This paper finds that the (...) precautionary approach is unable to sufficiently shape balanced legal intervention in this day and age. One of the main goals of scientific research is to provide a description of the empirical data which is as accurate and comprehensive as possible, while relying on as few and simple assumptions as possible. In this paper, I propose a definition of the notion of few and simple assumptions that is not affected by known problems. This leads to the introduction of a simple model of scientific progress that is based only on empirical accuracy and conciseness. An essential point (...) in this task is the understanding of the role played by measurability in the formulation of a scientific theory. This is the key to prevent artificially concise formulations. The model is confronted here with many possible objections and with challenging cases of real progress. Although I cannot exclude that the model might have some limitations, it includes all the cases of genuine progress examined here, and no spurious one. In this model, I stress the role of the state of the art, which is the collection of all the theories that are the only legitimate source of scientific predictions. A chemical substance is instantiated in the material world by a number of quantities of such substance, placed in different locations. A change of location implies a change in the net of relationships entertained by the QCS with the region wherein it is found. This fact entails changes of the ontological status of the CS, as this is not fully determined by the inherent features of the CS and includes a relevant relational contribution. I argue that the key to understand many fundamental issues in philosophy of science lies in understanding the subtle relation between the non-empirical cognitive values used in science and the constraints imposed by measurability. In fact, although we are not able to fix the interpretation of a scientific theory through its formulation, I show that measurability puts constraints that can at least exclude some implausible interpretations. This turns out to be enough to define at least one cognitive value that is (...) able to penalize, without damages, precisely those bad features that deceive purely empirical assessments. This leads to the formulation of a simple model of scientific progress, that is based only on empirical accuracy and conciseness. Luigi Giussani, a high school religion teacher throughout the 1950s and 1960s, grounded his teachings in the vast body of experience to be found in Christianity's two-thousand-year history. He told his students, “I'm not here to make you adopt the ideas I will give you as your own, but to teach you a method for judging the things I will say.” Throughout his life, education was one of Giussani's primary intellectual interests. He believed that effective education required an adequate (...) background in the Christian tradition, presented within a lived experience that underscored the capacity of the faith to answer universal questions. What he proposed was a process that allowed one to sift through tradition, critically examining it and comparing it against the ultimate criteria for judgment: the desires of the heart. In Giussani's view, the primary concern was to “educate the human heart as God made it.” In The Risk of Education he states that fear leads students to associate this process of criticism with negativity or doubt. Yet, without an education in criticism, students cannot develop conviction. At a time when young people are abandoning the church and questioning the value of faith, Giussani's method of judging and verifying Christianity as an experience seems a necessary intervention. In The Risk of Education he argues that, ultimately, education and the Christian message reveal themselves through human freedom. (shrink)

In this paper we compare the strategies applied by two successful biological components of the ecosystem, the viruses and the human beings, to interact with the environment. Viruses have had and still exert deep and vast actions on the ecosystem especially at the genome level of most of its biotic components. We discuss on the importance of the human being as contraptions maker in particular of robots, hence of machines capable of automatically carrying out complex series of actions. Beside the (...) relevance of designing and assembling these contraptions, it is of basic importance the goal for which they are assembled and future scenarios of their possible impact on the ecosystem. We can’t procrastinate the development and implementation of a highly inspired and stringent “ethical code” for human beings and humanoid robots because it will be a crucial aspect for the wellbeing of the mankind and of the entire ecosystem. The discovery of incommensurability by the Pythagoreans is usually ascribed to geometric or arithmetic questions, but already Tannery stressed the hypothesis that it had a music-theoretical origin. In this paper, I try to show that such hypothesis is correct, and, in addition, I try to understand why it was almost completely ignored so far.

The first part of this paper aims to highlight the analogies between Schutz’s vision of the natural attitude and Wittgenstein’s vision of a phenomenon that concerns the same problematic field, i.e. certainty, the belief of common sense that is free of all doubt, that the world “out there” is as it appears, absolutely real. These certainties form the basis, the foundation of language games and therefore of knowledge in general and in its entirety. This foundation is unfounded and yet indispensable. (...) The second part of the paper examines an important topic analysed by Wittgenstein, related to the aforementioned problem: the language transposition of pre-predicative, pre-reflective and non-propositional certainties, the cornerstones of which are “hinge propositions”, whose hybrid nature can be identified in the shift from empirical propositions to grammatical rules. Biological ontologies are used to organize, curate, and interpret the vast quantities of data arising from biological experiments. While this works well when using a single ontology, integrating multiple ontologies can be problematic, as they are developed independently, which can lead to incompatibilities. The Open Biological and Biomedical Ontologies Foundry was created to address this by facilitating the development, harmonization, application, and sharing of ontologies, guided by a set of overarching principles. One challenge in reaching these goals was that the (...) OBO principles were not originally encoded in a precise fashion, and interpretation was subjective. Here we show how we have addressed this by formally encoding the OBO principles as operational rules and implementing a suite of automated validation checks and a dashboard for objectively evaluating each ontology’s compliance with each principle. This entailed a substantial effort to curate metadata across all ontologies and to coordinate with individual stakeholders. We have applied these checks across the full OBO suite of ontologies, revealing areas where individual ontologies require changes to conform to our principles. Our work demonstrates how a sizable federated community can be organized and evaluated on objective criteria that help improve overall quality and interoperability, which is vital for the sustenance of the OBO project and towards the overall goals of making data FAIR. In this paper, I argue that Sellars’s conceptualist reading of Kant, though less radical than more contemporary approaches (e. g., Brandom, McDowell), relies on a controversial account of the relations between the givenness of intuitions, the productive imagination and the power of judgment. I will discuss: 1) how Sellars reconsidered Kant’s account of intuition; and 2) the kind of conceptualism he argues for. I will raise two main claims. First, Sellars’s conceptualist reading of intuition overlooks the role of space and (...) time as givenness conditions. Second, Sellars’s account of the productive imagination disregards the complementary significance of the power of judgment in a priori synthesis, the role of which is to grant synthetic unity. My aim is to reconstruct a consistent dialogue between Sellars and Kant by discussing Sellars’s reading of a priori synthesis and comparing his views to Kant’s original aims. (shrink)

Con l’ampliarsi del lavoro di rete, e la creazione di valore che ne deriva, i legami di partnership tra le imprese evidenziano un salto prestazionale. Ciò avviene anche attraverso la creazione di un’identità condivisa, che ne rafforza la competitività. Dopo la definizione di co-branding, e l’esposizione dei benefici e dei rischi, vengono considerate le opportunità di crescita che ne derivano. Queste (...) alleanze consentono alle reti tra imprese di riposizionarsi nel proprio contesto di appartenenza, migliorando la governance e le strategie di mercato. Anche la relazione con l’attuale crisi economica evidenzia la capacità del co-branding di fronteggiare con maggiore efficacia i momenti di emergenza. Come evidenziato in numerose ricerche, la gestione della crisi trova nelle alleanze di brand uno strumento strategico essenziale per crescere anche se l’instabilità e l’incertezza dell’economia sono elevate. Attraverso l’esame di alcuni case-histories, viene elaborato un modello di co-branding. Si tratta di un prisma dove sono evidenziati sei asset strategici: velocità, personalizzazione, flessibilità, facilità, dialogo e convergenza. Sono questi i fattori che hanno determinato una performance di successo durante la crisi. I risvolti positivi che ne derivano avranno un impatto evidente anche dopo il periodo di emergenza. (shrink)

Simple assumptions represent a decisive reason to prefer one theory to another in everyday scientific praxis. But this praxis has little philosophical justification, since there exist many notions of simplicity, and those that can be defined precisely strongly depend on the language in which the theory is formulated. The language dependence is a natural feature—to some extent—but it is also believed to be a fatal problem, because, according to a common general argument, the simplicity of a theory is always trivial (...) in a suitably chosen language. But, this trivialization argument is typically either applied to toy-models of scientific theories or applied with little regard for the empirical content of the theory. This paper shows that the trivialization argument fails, when one considers realistic theories and requires their empirical content to be preserved . In fact, the concepts that enable a very simple formulation, are not necessarily measurable, in general. Moreover, the inspection of a theory describing a chaotic billiard shows that precisely those concepts that naturally make the theory extremely simple are provably not measurable. This suggests that—whenever a theory possesses sufficiently complex consequences—the constraint of measurability prevents too simple formulations in any language. This explains why the scientists often regard their assessments of simplicity as largely unambiguous. In order to reveal a cultural bias in the scientists’ assessment, one should explicitly identify different characterizations of simplicity of the assumptions that lead to different theory selections. Literature has been dealing with modern work and its psychological and social consequences through two kinds of narrations: verismo/realism and symbolism. Jack London wrote incredibly penetrating pages from a psychological viewpoint with a veristic prose; Kafka widened the reflection with his symbolism and, particularly, through dreamlike parables. Kafka was not a passive and absent-minded employee. Recent studies on his working documents have shown considerable passion and professional competence. This expertise was poured into his literary works about work and organizations with (...) a direct knowledge. Kafka's symbolist style has been very effective in changing the way to see organizations. The writer particularly realized the growth of the exceeding population in recent years and could grasp the workers' psychology and deeper aspects when they face their superfluity and expulsion from the world of work. More specifically, Kafka was able to analyze psychological surrender to superfluity, which is mainly expressed with a specific form of “mental emptiness,” already described by London. (shrink)

We discuss how transgenerational communitarianism deals with public decisions involving tradeoffs between different generations’ wellbeing and having global consequences. Policies for tackling climate change are an example. Although there is a natural, evolutionary, basis for intergenerational altruism, most people lack the competencies for constituting a transgenerational community. Moreover, greater attention to future generations’ wellbeing need not substitute for collective action: a lower discount rate reflecting a stronger concern for future generations may even worsen their wellbeing. Finally, in a world of (...) irreducible value pluralism, there is no community of persons sharing moral values that can legitimize common policies for addressing global problems: only the common interest of avoiding destructive consequences may motivate collective action to face problems like climate change. The point of view advocated, in the last ten years, by quantum probability about the foundations of quantum mechanics, is based on the investigation of the mathematical consequences of a deep and elementary idea developed by the founding fathers of quantum mechanics and accepted nowadays as a truism by most physicists, namely: one should be careful when applying the rules derived from the experience of macroscopic physics to experiments which are mutually incompatible in the sense of quantum mechanics.

We reedit in the dossier of this issue an essay of Luigi Luzzatti first came out in «Nuova Anthologia» in 1880. In it Luzzatti rereads the British constitutional history thanks to a set of biological metaphors and analogies, which are analyzed and historically framed in the introduction of Luca Ciancio. This approach of Luzzatti further enhances the reconstruction of history of Constitutions he offers analyzing the works of the greatest historians of his time.

The modern outlook on emancipation has made its quest inseparable from a quest for endless enhancement, based on an ever-more intensive exploitation of the biophysical world. This accounts for how unsustainable ways of living are reiterated worldwide, in spite of evidence of their deleterious effects. The underpinnings of unsustainability, and a major impediment to conceiving alternatives, come from an account of the human as ontologically indeterminate, crushed on doing, both vulnerable and powerful towards the world. The impasse of such ambivalence (...) hampers social theory critique, from post-humanist ontologies to the case for degrowth and lifestyle politics. The article outlines a different take on emancipation. An account is provided of form-of-life as a doing tailored to being – not as a self-enclosed monad but as a result of the encounter between own ‘inclination’ and the world. The distinction between open and closed class items represents a fundamental bifurcation in the mental lexicon. It proved useful to express certain basic generalisations in linguistics and in the study of language acquisition and language pathology. The distinction is too rough tough: it must be refined by paying attention to the computational properties of the two classes and their division of labor in the generation of complex expressions. The article presents sociological considerations in regards to the advent of globalism. With the implosion of capitalism and the acceleration of globalization, the concept of globalism is in need of new interpretations. Some sociologists indeed would see it solely as the ideology of globalization. In the article, globalism is regarded as a social system not only with ideological characteristics but also economic ones. This radically changes the very logic of capitalism, which is focused on linear and monocentric production. Through the (...) theory of link-value the article illustrates the process by which economic development takes place. It is shown that as well as the assets identified by the main economic schools, development is based on factors such as infrastructure investments, technologies, and networking. Today, with globalism, it is economic ties that create wealth and they are more important than the production process itself. Such transformation is highlighted through the growth of the financial and commercial dimensions, as well as the change in industrial activities. The article deals with the fundamental importance of the global value chain in nowadays, as well as the reshoring and the nearshoring. After illustrating the evolution of territorial networks, several case histories are presented: from the new economic centres of globalism to the decline of industrial districts. Finally, the article examines new generations models of innovation and culture districts. Thaler and Sunstein justify nudge policies from welfaristic premises: nudges are acceptable because they benefit the individuals who are nudged. A tacit assumption behind this strategy is that we can identify the true preferences of decision-makers. We argue that this assumption is often unwarranted, and that as a consequence nudge policies must be justified in a different way. A possible strategy is to abandon welfarism and endorse genuine paternalism. Another one is to argue that the biases of decision that choice (...) architects attempt to eliminate create externalities. For example, in the case of intertemporal discounting, the costs of preference reversals are not always paid by the discounters, because they are transferred onto other individuals. But if this is the case, then nudges are best justified from a political rather than welfaristic standpoint. (shrink)
